The Mobile Phone Law and You

Tough new penalties for using hand held mobile phones came in to effect from midnight on 27 February 2007.

You must not:


· Drive while holding a mobile phone
· Supervise a driver while holding a mobile phone
· Cause or permit a driver to drive while holding a mobile phone

If you breach the law the new penalties are:

· 3 penalty points
· Fixed penalty notice fine increased to £60
· Cases dealt with by the court can incur a fine of up to £1,000
• (or £2,500 for drivers of goods vehicles, buses or coaches)

How does the law apply?

While driving, you will be breaking the law if you pick up or use any type of phone or similar device that is, or must be, held to operate it. For example, this means you may not use your mobile phone:

· when you are stopped at traffic lights;
· when you are queuing in traffic;
· to make or receive calls, text messages or to access the Internet.

If you are an employer, you too can be prosecuted if you require employees to make or receive calls using a hand-held mobile phone while driving.

Using Hands Free Car Kits
It is illegal to drive a vehicle or ride a motorcycle and use a held mobile phone or similar device, but if you do need to use your mobile phone whilst in the car, a professionally fitted hands free car kit is the best way to stay safe and avoid any fines or points on your licence.
